Frequently Asked Questions About Taxes in Spain

Do foreigners have to pay tax in Spain?

Yes. Foreigners may have Spanish tax obligations depending on whether they are tax resident in Spain and whether they own property, receive income or make investments in Spain. Non-residents are generally taxed on Spanish-source income, while Spanish tax residents are generally subject to Spanish income tax on their worldwide income, subject to applicable double-tax treaties.

As a general rule, you may become tax resident in Spain if you spend more than 183 days during a calendar year in Spain, or if the main centre of your economic activities or interests is located in Spain. There is also a rebuttable presumption of Spanish residence when your non-separated spouse and dependent minor children habitually live in Spain. Double-tax treaties may apply if two countries consider you resident at the same time.

A non-resident owner of Spanish property may have several tax obligations. These can include local property tax (IBI), Non-Resident Income Tax on rental income, and in some cases an annual tax on imputed property income when the property is for personal use or remains vacant. Wealth Tax or other asset-based taxes may also apply depending on the value and circumstances of the owner.

Modelo 210 is the Spanish Non-Resident Income Tax return used by non-residents without a permanent establishment in Spain to declare certain Spanish-source income. Property owners commonly use it to declare rental income, imputed income on properties kept for personal use, and capital gains arising from the sale of Spanish real estate.

Yes. If a non-resident rents out a property located in Spain, the rental income is generally subject to Spanish Non-Resident Income Tax and is normally declared through Modelo 210. The taxable amount and the expenses that may be deductible depend on the taxpayer’s circumstances and country of tax residence

A sale may trigger Spanish capital gains tax and, depending on the municipality, local Plusvalía Municipal. If the seller is non-resident, the buyer is generally required to withhold 3% of the purchase price and pay it to the Spanish Tax Agency as a payment on account of the seller’s final tax liability. If the withholding exceeds the final tax due, the seller may claim a refund.

If you are Spanish tax resident, you are generally taxed on your worldwide income, including certain income earned outside Spain. Double-taxation treaties and foreign tax credits may prevent the same income from being taxed twice. Depending on your assets and circumstances, additional reporting obligations relating to foreign assets may also arise.

Yes. In fact, obtaining tax advice before becoming Spanish tax resident can be particularly useful. We can review your income, pensions, investments, property, company interests and expected residence status in order to identify Spanish tax obligations in advance and consider the most appropriate structure before the move.
