Concept
Holiday homes-Tourist rent are those homes that, furnished and equipped in conditions of immediate use and meeting the requirements demanded by the regulations, are marketed or promoted in tourist supply channels, to be temporarily and in their entirety transferred to third parties, on a regular basis, for the purpose of holiday accommodation and in exchange for a price.
Habituality occurs when the transfer of the home is made two or more times within a period of one year or once a year, but repeatedly; and by temporary transfer, it is understood the entire occupation of the home for a period of time, which does not imply a change of residence by the person.
Homes subject to the horizontal property regime can only be marketed when the statutes of the community of owners do not prohibit the activity.
Requirements
Holiday homes must have a minimum equipment in each of their rooms, in proportion to the number of occupants and according to the activity carried out in them. By way of example:
– Security lock on access doors;
– First aid kit;
– Effective darkening system for each bedroom it has;
– Appliances, etc.
The prices of the accommodation service must be displayed in the dwellings , containing the date on which they are advertised or publicly announced and, therefore, applied. Also, a badge must be displayed in a visible place at the entrance, as long as there is no express prohibition by the rules of the community of owners.
Procedure for starting activity
The following requirements must be met:
- Prior to the start of the activity, the owners of the activity must submit the responsible declaration to the corresponding island council, which states:
– that the legal requirements are metand that they have the documentation that proves this, with the commitment to continue doing so during the period that the home is dedicated to this activity;
– In the statutes of the community of owners to which the property belongs, there is no express prohibition that prevents it from being used as a holiday home;
– The number of bedrooms and that the maximum occupancy capacity will not be exceeded, in accordance with the accredited conditions of the home.
- Together with this declaration of commencement of activity, the following must be attached:
– certificate of occupancy or first occupancy licence; and
– Responsible declaration, if applicable, that in the statutes of the community of owners there is no prohibition that prevents the placement of identification plates of the activity of the holiday home, outside or common areas.
