Concept
Dwellings for tourist use are defined as those flats, houses, chalets or other similar properties, furnished and equipped in conditions of immediate use, which are marketed or promoted in tourist supply channels to be temporarily transferred on two or more occasions a year, being advertised in any type of marketing channel of their own or of a third party. for the purpose of tourist accommodation and in exchange for consideration.
Dwellings for tourist use that carry out the activity of tourist accommodation on a regular basis may not be used as a permanent residence or for any other purpose other than tourist use.
Requirements
The homes for tourist use have the capacity determined in the first occupancy license and are composed, at least, of a living-dining room, kitchen, bedroom and bathroom. Along with this, they must:
– comply with the provisions of current regulations on habitability and safety for residential use as a home;
– Comply with the statutes of the community of owners, which cannot contain an express prohibition for the activity of tourist accommodation;
– Have direct ventilation to the outside or to patios, with blinds or with a similar darkening system on the windows;
– Be furnished and equipped with all the necessary appliances and equipment for immediate use and according to the number of places occupied;
– have heating and air conditioning in the bedrooms and living room;
– Have a first aid kit;
– Provide the cleaning service of the home upon the arrival and departure of new clients;
– Have bed linen, linen, household goods in general, depending on the maximum occupancy of the home and a replacement set;
– Make a telephone number available to users to attend and resolve doubts and incidents related to the home immediately in a visible place;
– The operating instructions of the appliances or other devices that require it for their correct use must be made available to the users of the home;
– Have a Wi-Fi internet connection;
– Make available to customers the internal rules regarding the use of the facilities and dependencies of the home, as well as the admission or not of pets, restrictions for smokers, and restricted use areas.
On the entrance door of each dwelling for tourist use, in a visible place, a standardised distinctive plaque must be displayed, in accordance with the appropriate technical prescriptions.
Dwellings for tourist use located in the historic areas of World Heritage cities must display, next to the main entrance of the establishment and in a visible place, the standardised distinctive plaque specific to these cities.
In all advertising, promotional or marketing actions, the registration code of the Register of Tourist Companies and Establishments of Castilla-La Mancha must appear.
Procedure for starting activity
The companies or owners of the operation of tourist apartments and tourist accommodation must:
- Submit the responsible declaration of start of activity to the competent tourism body.
- Once the responsible declaration has been submitted, it must be registered in the Register of Tourist Companies and Establishments of Castilla-La Mancha.
