In La Rioja, homes for tourist purposes are called homes for tourist use. In addition to its regulation, its procedure for starting activity is discussed.

Concept

Dwellings for tourist use are those furnished and equipped in conditions of immediate use, subject to a temporary transfer for a tourist purpose and in their entirety, and are marketed or promoted for profit in tourist supply channels, and are not part of an apartment.

With the entry into force of the law, the assignment by rooms is no longer prohibited, although these cases must be subject to the regime applicable to pensions, requiring the communication of the start of activity as such.

The  maximum capacity of accommodation places is double the number of rooms in the house, including the living room, and up to a maximum of 8, including possible convertible and extra beds.

The capacity will be determined by the total number of beds in the rooms, with beds with a width of more than 1.35 metres being counted as two accommodation places.

In La Rioja, dwellings for tourist use are not considered dwellings, even if they meet the rest of the requirements, those that are intended for rental for a single consecutive period equal to or less than 3 months a year, regardless of the effective occupancy in that period.

A dwelling may not be used for tourist use when, where appropriate, it is prohibited by the statutes of the community of owners, or does not comply with the municipal regulations that were applicable to the exercise of the activity. In addition, when the dwellings are part of a community of owners, complementary services and facilities may not be offered to the activity of accommodation or lodging likely to cause inconvenience and damage to the neighbours.

The management of dwellings for tourist use can be carried out both by natural persons who are not professionally or habitually engaged in this task and by management companies, this being considered the natural or legal persons, owners or not of the accommodation, who regularly and professionally carry out the management of the transfer of the accommodation.

The dwellings must meet, in any case, the minimum conditions required by the regulations governing the conditions of habitability of dwellings.

Procedure for starting activity

For the start of the activity, a communication of the start of the activity must be submitted, which will allow the activity to be carried out for an indefinite period of time from the day of its presentation.

However, additional obligations have been established with respect to the documentation that must be attached to the communication of the start of activity of the establishments. In this way, it must be accompanied by the one required to verify compliance with the applicable sectoral regulations, especially urban planning regulations, in order to proceed with the corresponding classification and registration in the Register of Tourist Service Providers.
